Terms of Service

1. About these terms

These Terms of Service ("Terms") are an agreement between you and Taoftware LLC ("Taoftware", "we", "us"). They cover the Drawriors game in a web browser at drawriors.com, the Drawriors apps for iPhone, iPad and Android when they are released, and this website (together, "Drawriors"). By playing Drawriors you agree to these Terms. If you don't agree, please don't use Drawriors.

2. Kids and grown-ups

Drawriors is made for everyone, including children. If you are a child, please play with the permission of a parent or guardian. Parents and guardians accept these Terms on behalf of the children they let play, and are responsible for any purchases made on their devices.

3. Free to play, and in-game items

Drawriors is free to play. Coins, gems, items, skins and other in-game things are a limited license to use them inside Drawriors. They have no real-world value, can't be exchanged for money or anything outside the game, and can't be sold or transferred except through features the game offers (such as its Market). We may change how in-game items and prices work, for example to keep the game balanced.

If optional purchases are offered, they are protected by a grown-up check and spending limits. Purchases in the apps are handled by the Apple App Store or Google Play under their terms, and refund requests go to them. Purchases on the web are handled by our payment provider; contact us about any problem with one.

4. Your drawings

You keep the rights to the drawings you make. You allow us to store, copy and show them only as needed to run the features you use: syncing them to your other devices, sending them to the players in an online fight, and showing them to anyone who opens a share link you created. When you stop sharing or delete your cloud data, we stop using them.

Share links are public: anyone with the link can see the drawing. Don't put personal information (like a real name, address or school) in a drawing or nickname you share, and only share drawings you made or have permission to share.

5. Playing fair and being kind

Please don't:

• share or fight with drawings that are hateful, violent, sexual, bullying or otherwise not OK for kids;
• cheat in online fights, or interfere with, overload, probe or attack our servers;
• use bots or scripts to create share links, results or reports;
• copy, sell or redistribute Drawriors, or use it for commercial purposes, without our permission;
• break the law, or help anyone else break these rules.

We may remove share links or other content, and block access to online features, if we believe these rules have been broken. Players can report share links, and links are hidden automatically after several reports.

6. Your save data

Your game is saved on your device. It can be lost if your browser or device data is cleared, the app is uninstalled, or the device is lost or broken. Use Saves & backups to keep a backup file, or turn on cloud sync. Keep your sync code private: anyone who has it can load and change your synced game. We are not responsible for lost save data or in-game items, except where the law says otherwise.

7. A game in active development

We are always improving Drawriors. Features, creatures, arenas, items and online services may change, be added or be removed, and the game may sometimes be unavailable. Online features such as cloud sync, online fights and share links depend on our servers and may change or end; if we plan to shut one down, we will try to give notice in the game first.

8. Our rights

Drawriors, including its name, logo, mascot, artwork, sounds, music and code, belongs to Taoftware and is protected by copyright and trademark laws. We give you a personal, non-exclusive, non-transferable, revocable license to play Drawriors for non-commercial use, under these Terms.

9. Privacy

Our Privacy Policy explains what data leaves your device and when. It is part of these Terms.

10. App stores

If you get a Drawriors app from the Apple App Store or Google Play, these Terms are between you and Taoftware, not Apple or Google. The store's own terms also apply. Apple and Google have no responsibility to provide maintenance or support for the app. For apps downloaded from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

11. Disclaimer

DRAWRIORS IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DON'T PROMISE THAT DRAWRIORS WILL BE UNINTERRUPTED, ERROR-FREE OR THAT SAVE DATA WILL NEVER BE LOST.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAOFTWARE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST DATA OR IN-GAME ITEMS, ARISING FROM YOUR USE OF DRAWRIORS. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR DRAWRIORS IN THE 12 MONTHS BEFORE THE CLAIM, OR US$50. Some places don't allow these limits, so they may not apply to you.

13. Ending these terms

You can stop playing at any time and delete your data as described in the Privacy Policy. We may suspend or end your access to online features if you break these Terms. Sections 6, 8, 11, 12 and 14 continue to apply after these Terms end.

14. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Disputes will be handled in the courts located in Orange County, California, unless the law where you live gives you the right to bring a claim locally.

15. Changes

We may update these Terms. We will post the new version here and update the date at the top; for important changes we will also let you know in the game. If you keep playing after a change, you accept the updated Terms.
